Luckin Secures Major Trademark Victory in Thailand – CoffeeTalk

Luckin Coffee has achieved a decisive victory in its trademark appeal in Thailand, as the Thai Court of Appeal for Specialized Cases upheld a previous ruling that mandated a local company using the Luckin brand to pay over 95 million baht in damages. This decision involved both the cancellation of the defendant’s trademark registrations and a permanent ban on the use of the names “LUCKIN COFFEE” and “瑞幸咖啡,” along with the deer-head logo in coffee-related enterprises.

The awarded damages comprise a 10 million baht lump-sum payment and an additional 85 million baht for ongoing damages due to trademark infringement. The conflict originated in 2021, when various Thai entities preemptively registered Luckin’s trademarks—including its English and Chinese names and its logo—prior to Luckin’s intended entry into the Thai market. In response, Luckin initiated trademark cancellation and infringement lawsuits, leading to a favorable ruling from Thailand’s Central Intellectual Property and International Trade Court in March 2025. The appeals court subsequently dismissed the defendants’ claims on July 8, fully endorsing the earlier court’s decision.

The ruling is notable for reaffirming Thailand’s stance against bad-faith trademark registrations, adopting a holistic view of damages that accounts for impacts on market access, international growth, brand reputation, and legal enforcement expenditures. In terms of performance, Luckin reported a revenue of 49.29 billion yuan and a Gross Merchandise Value (GMV) of 56.65 billion yuan in 2025, along with a net profit attributable to shareholders of 3.6 billion yuan. The company expanded aggressively within the year, adding 8,708 net new stores, bringing its total to 31,048 locations by the end of 2025.
