US Supreme Court Strikes Down Country-Specific IEEPA Tariffs While New 15% Global Tariff Is Announced – CoffeeTalk

The U.S. Customs and Border Protection (CBP) agency announced it will stop collecting tariffs imposed under the International Emergency Economic Powers Act (IEEPA) at 12:01 a.m. EST on Tuesday. This decision follows the U.S. Supreme Court’s ruling that declared the duties illegal more than three days prior. In a communication to shippers via its Cargo Systems Messaging Service (CSMS), CBP stated it will deactivate all tariff codes associated with former President Donald Trump’s IEEPA-related orders starting Tuesday.

The halt in IEEPA tariff collections coincides with Trump’s introduction of a new 15% global tariff under a different legal framework intended to replace the tariffs invalidated by the Supreme Court’s ruling on Friday. The CBP did not explain why it continued to collect IEEPA tariffs for several days post-ruling and did not provide information regarding possible refunds for importers affected by the previous tariffs. It clarified that the cessation of IEEPA tariffs does not impact other tariffs imposed by Trump, particularly those established under Section 232 concerning national security and Section 301 pertaining to unfair trade practices.

Additional guidance for the trade community will be communicated by CBP through CSMS messages as necessary. According to a report by Reuters referencing the awarded ruling, the Supreme Court’s decision opens the door for more than $175 billion in revenue generated by the IEEPA tariffs to be subject to refunds. Research from Penn-Wharton Budget Model economists indicated that IEEPA tariffs were producing over $500 million daily in gross revenue prior to the court’s decision.
