Verve Coffee Workers Vote to Ratify Landmark Union Agreement with Industry-First Protections – CoffeeTalk
Unionized workers of Verve Coffee Roasters are voting to ratify a landmark labor agreement, potentially marking the company’s first labor contract following a recent unionization effort across multiple locations in California. This contract, the first among recently unionized specialty coffee shops in the Bay Area, includes crucial provisions such as protections against artificial intelligence (AI) in management decisions, enhanced paid sick leave, and defined hours for full-time employees. Approximately 60 employees from five stores will cast their votes electronically after a ten-month negotiation process.
Employee Annika Mikk, a member of the Verve Workers United bargaining committee, expressed empowerment in the negotiation process, highlighting that workers can now address issues directly with management. The United Food and Commercial Workers Local 5 (UFCW5), representing the union, noted that the agreement’s AI clause—a historic measure preventing managerial decision-making from being influenced by AI—was a significant achievement amidst growing concerns over AI’s role in employment and performance evaluations.
Recently, Verve Coffee Roasters had introduced AI-driven assessments of employee performance, raising alarms about potential biases in promotion and disciplinary decisions based on AI-generated evaluations. Employee concerns were further exacerbated as AI began to categorize staff members in scheduling software, prompting fears that such classifications could lead to unfair reprimands. The union successfully incorporated language in the contract ensuring that employees would not face disciplinary action solely based on AI assessments.
The increasing implementation of AI tools in the food service industry poses broader implications for workers, with 26% of restaurant operators reportedly utilizing such technologies, as indicated in the National Restaurant Association’s latest report. As AI becomes progressively integrated into various operational aspects, labor unions nationwide are striving for legislative and contractual measures to safeguard workers from unforeseen AI applications.
Polling data from the AFL-CIO reveals that a vast majority of workers desire human oversight in AI decision-making, transparency from employers regarding AI usage, and strict limits on AI implementation in workplaces. The survey indicated that 95% of respondents preferred a human final decision-maker in employment-related matters, while 92% supported stringent safeguards around AI deployment. Notably, workers exhibited higher trust in unions than in employers or lawmakers concerning AI protections.
UFCW5’s Jim Araby emphasized the urgency of establishing legal frameworks to address AI’s implications in the workplace, acknowledging the challenges of creating precise language to govern continually evolving AI technologies. In addition to AI-related provisions, the contract achieved significant improvements in paid sick leave, offering an extra $5 per hour for sick leave to help mitigate lost tip earnings, a groundbreaking step in the industry.
Further, agreements were reached on guaranteed hours for full-time staff, a minimum 14-day notice for scheduling, clearer pathways for part-time staff to transition to full-time roles, the implementation of a wage progression system, and a small parking stipend. This contract exemplifies a shifting dynamic towards a more responsive and collaborative relationship between Verve management and employees, as noted by Mikk.
