Class Action Lawsuit Filed Against Major Coffee Chains For Non-Dairy Milk Surcharges – CoffeeTalk
Montreal law firm LPC Avocat is suing major coffee chains, including Tim Hortons, Starbucks, and Second Cup, for allegedly unfairly charging customers extra for non-dairy milk substitutes in their lattes. The lawsuit targets these chains, accusing them of profiting from the practice for years. The class action lawyer, Joey Zukran, argues that this practice affected a significant portion of customers, particularly those who are lactose intolerant, health-conscious, or vegan. The class action, which has yet to be proven in court, argues that the coffee chains engaged in “highway robbery” and characterizes the surcharge as an abusive charge under the Quebec Consumer Protection Act. The price of milk substitutes has dropped significantly over the years, often falling below the cost of regular cow’s milk. Starbucks announced last fall that it would no longer charge extra for non-dairy options, and Tim Hortons followed suit, changing its policy just last week. Despite these changes, Zukran believes that the coffee chains should still compensate customers for past charges, as they have collected millions of dollars in the aggregate.
